Terms of Service — NexTransfer Printing

1) Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the website, online store, and related services provided by NexTransfer Printing (“NexTransfer,” “we,” “us,” or “our”). By visiting our site, placing an order, creating an account, or otherwise using our services (collectively, the “Services”), you agree to be bound by these Terms and our Privacy Policy.

2) Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3) Orders, Artwork & Proofs

3.1 Custom-Made Products. Most items we sell (e.g., DTF transfers, UV DTF decals, gang sheets) are made to order from the artwork you provide.
3.2 Artwork Responsibility. You are solely responsible for the content, quality, and legality of submitted artwork/files (including trademarks, copyrights, and likeness rights). You represent that you have all necessary rights and permissions to use, reproduce, and have us print such artwork.
3.3 File Standards. Follow our posted Artwork Guidelines (file type, resolution/DPI, transparency, sizing). We may perform a basic courtesy check, but final responsibility for print-readiness remains with you.
3.4 Color & Tolerances. Exact color matching is not guaranteed unless explicitly quoted and approved in writing. Minor color shifts may occur due to monitors, inks, substrates, and curing. Standard manufacturing tolerances (e.g., registration or size variance ±2–3 mm) are not considered defects.
3.5 Proofs. Where we provide digital or physical proofs (if purchased), production begins after your approval. Approved proofs are deemed correct and final.

4) Pricing, Taxes & Payment

Prices are listed in U.S. dollars and may change without notice prior to order acceptance. Applicable taxes and shipping are calculated at checkout. We accept the payment methods shown at checkout and may use third-party processors. By submitting payment, you authorize all charges for the order. Orders may be declined or canceled for suspected fraud, unauthorized use, or other lawful reasons.

5) Production & Turnaround

Published lead times (including same-day / next-day options) are estimates and begin after we receive a complete, print-ready order and any required approvals. Rush services are subject to capacity. We are not responsible for delays caused by incomplete files, late approvals, or events beyond our reasonable control (see Force Majeure).

6) Shipping, Risk of Loss & Delivery

We ship via the carriers offered at checkout. Risk of loss passes to the carrier upon handoff. Carrier delays are not refundable. Inspect packages upon delivery and notify us of shipping damage or shortages within the timeframe in our Return & Refund Policy.

7) Returns, Refunds & Reprints

Custom products are generally non-returnable except as stated in our Return & Refund Policy. If an approved claim is validated (e.g., manufacturing defect or our error), we may repair, reprint, or refund at our discretion. Using/pressing disputed transfers may void eligibility.

8) Pressing & Application Disclaimer

Final results depend on your press model, temperature calibration, pressure uniformity, substrate, and technique. Always test on a sample and follow our Pressing Instructions. Failures caused by incorrect application are not covered.

9) Prohibited Content & Use

You may not submit artwork or use the Services to create materials that are illegal, infringing, deceptive, obscene, harassing, hateful, or that promote violence or discrimination. We may refuse or cancel any order that, in our reasonable judgment, violates these standards or applicable law.

10) Intellectual Property

All site content (graphics, text, logos, photos, software) is owned by NexTransfer or its licensors and protected by law. Subject to these Terms, we grant you a limited, revocable, non-exclusive license to access and use the site for purchasing our products.
User Content License. You grant NexTransfer a non-exclusive license to use, reproduce, and modify your submitted artwork solely to produce and deliver your order and to provide related customer service.

11) Third-Party Services

Our Services may link to or integrate with third-party platforms (e.g., payment processors, design/apps). We are not responsible for third-party services, and your use of them may be governed by their own terms and privacy policies.

12) Privacy

We collect and process personal information as described in our Privacy Policy, which is incorporated into these Terms.

13) Warranties & Disclaimers

THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTRANSFER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEXTRANSFER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOST PROFITS; LOSS OF DATA; OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES OR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM.

15) Indemnification

You agree to defend, indemnify, and hold harmless NexTransfer and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your artwork/content; (c) your breach of these Terms or applicable law.

16) Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control, including but not limited to accidents, equipment failure, labor disputes, shortages, pandemics, acts of God, or carrier issues.

17) Governing Law & Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Dallas County, Texas.

18) Changes to the Terms

We may update these Terms from time to time. Changes are effective when posted to this page with the “Last updated” date. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
